Terms and conditions of use

This application (hereinafter, the App) is owned by Santillana Global, S.L. (hereinafter, Santillana), a Spanish company with registered address at Avenida de los Artesanos, 6, 28760 Tres Cantos, Madrid (Spain) and tax number B-28405355, filed at the Madrid Companies Registration Office in tome 4,014, general volume 3,243, section 3, folio 78, sheet 31,004, entry 1.

Users are responsible for knowing the terms and conditions of use before accessing the App's products and services; if you do not accept them, please abstain from using the App.

INTELLECTUAL PROPERTY

Intellectual property and all the operating rights of both the App and of all its individual items are owned by Santillana, which has the intellectual property over the App at all times and over the copies made thereof (whatever the medium in which they are included); only the user rights over the App described below are granted. Any rights which are not expressly granted are understood to be reserved and owned solely by Santillana. Santillana is also the sole owner of the App's design and graphic image and it reserves the actions that legally correspond to it vis-à-vis the persons who make unfair imitations or use thereof. Santillana's brands or those of third parties which, where applicable, appear on the App cannot be reproduced or used separately outside the App's places where they appear.

DATA REGISTRATION AND PROTECTION

Users can supply their personal data to the App directly through a form established for such purpose or through the APIs of the social media which have previously treated such data: Facebook, Twitter or Google+. In all cases, by registering their data using any of the procedures, they accept the data treatment described herein.

After registration, the users' personal data are included in a file under the responsibility of Santillana Global, S.L., filed at the Spanish Data Protection Agency under APP USERS, with registration code 2160354526.

The purpose of that file is to manage the use of and access to the App, answer queries and send commercial information related to Santillana Global, S.L. and its educational activities. By accepting these terms and conditions, users freely and expressly accept that Santillana can carry out the aforementioned actions.

Santillana can monitor the App users' activity through its own analytical tools or those of third parties such as Google Analytics and others.

Users authorise Santillana to subcontract to a third party the functions, tasks and/or responsibilities arising from the personal data treatment related to the storage of the data supplied to or entered in the App.

Users can exercise their right to access, rectify, cancel and challenge this at any time by sending an email to movapp@santillana.com or a letter to the address stated at the start of these terms and conditions, including a copy of their identity or equivalent document, identifying themselves as users of the App and providing the contact data supplied previously.

CONTENT AND DOWNLOADS

ALLOWED USES

The following is allowed: The use of the App and of all the features that it includes in a device; any temporary or ancillary reproduction is authorised, provided that it is not voluntary or forms an integral and essential part of the technological transmission process.

Any uses or reproductions, distributions, public communications or transformations of the App, its content, the downloaded products and the copies of all of them are forbidden, as well as any uses which contravene the law, common usage or good faith, especially:

•    Any uses thereof other than for personal and private purposes, especially those entailing commercial or professional purposes.

•    Any modifications thereto and, in general, any transformations thereof, including their translation, adaptation, adjustment or any other transformation, including any software error correction. No successive versions or derivative software may be developed based on said software.

•    Any uploads and/or uses thereof in any computer network system, tablets or any other devices which allow for their reproduction and use, even if users cannot obtain simultaneous access thereto.

•    Any types of partial or full extractions, public communications and/or transmissions by any means outside the scope of use allowed and, specifically, their inclusion in any other work, collections or databases.

•    The removal, concealment or falsification of the App's intellectual or industrial property rights.

•    All operations and activities expressly forbidden in the other sections of these general terms and conditions and, in general, any of those which are able to damage the normal functioning of the App, Santillana, other users or third parties.


CONTENT AND USER BEHAVIOUR

As the client or user of the App, you undertake to make proper use thereof and of its content and not use them to (i) engage in illicit or unlawful activities, or any activity contrary to the principle of good faith and public order; (ii) disseminate content or propaganda of racist, xenophobic or pornographic nature, or arguing in favour of terrorist activities, or against human rights; (iii) damage the physical and logical systems of Santillana, its suppliers or third parties, or to introduce or spread computer viruses through the internet or any other physical or logical system capable of causing the foregoing damages; (iv) disseminate content that may compromise Santillana’s or any third party’s image; or (v) harm the intellectual or industrial property or image rights or the honour and other rights corresponding to Santillana or to third parties. Any breach of the rules included in these terms and conditions of use and, specifically, of that envisaged in this clause shall enable Santillana to immediately unsubscribe the users from the App.

CHANGES

Santillana reserves the right to make the changes it deems appropriate to the App without prior notice and it can change, delete or add the content and services provided through it as well as the way in which they are presented or located. Although Santillana will devote its greatest efforts to keep the information contained in the App free of errors and updated, it does not offer any guarantee in connection with its accuracy and updated status. No specific results or purposes are guaranteed either and, therefore, the access to and use of the App are the sole responsibility of the users and clients. Consequently, Santillana does not guarantee an uninterrupted or free of error access and it is exempt of any liability for damages arising from the use or lack of use thereto (including indirect damages such as loss of profit, business opportunity or information, etc.).

COOKIE POLICY

The App may use third-party analytical cookies, which enable us to quantify the number of users and thus carry out the statistical measuring and analysis of how users use the App. To do this, the App's use is analysed with the aim of including improvements in its functioning and/or improving the product or service offering.

Every time that a user accesses the App, we use a tool (Google Analytics) from an external supplier (Google), which generates the analytical cookies in the user's device. Those cookies, which are only generated when the user carries out an action, are permanent and are used in the subsequent accesses to the App to anonymously identify the visitor. Remember that permanent cookies expire when their objective has been met or when they are manually deleted.

LEGAL ACTION

Santillana shall pursue the non-compliance with these terms and conditions of use and any undue use of the App or its content, as well as breaches of the rights corresponding to it or to its licensors, especially the intellectual and industrial property rights, carrying out all the civil and criminal action available to it under the law.
